At PetPay, we value our community. You trust us with your information, and we’re serious about that responsibility. We believe in transparency, and we’re committed to being upfront about our privacy practices, including how we treat personal information we collect or receive. We know you care about your privacy, too, so we provide settings that allow you to control how certain information is used on PetPay. This policy explains our privacy practices for PetPay.com and services provided by PetPay, Inc. (“PetPay”). By visiting this website, you are accepting the terms of this Privacy Policy. Any external links to other websites are clearly identifiable as such, and we are not responsible for the content or the privacy policies of these other websites.

PetPay complies with the US - EU Safe Harbor framework and the US - Swiss Safe Harbor framework as set forth by the US Department of Commerce regarding the collection, use and retention of personal data from European Union member countries and Switzerland. PetPay adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access and enforcement. Information Collected or Received

PetPay will not sell or disclose your name, email address or other personal information to third parties without your explicit consent, except as specified in this policy.

As an PetPay member you are required to provide a valid email address at registration.

Depending on which services you choose to use, PetPay may require additional information, such as your name, kennel name, billing and payment information (including billing address, telephone number, credit card information), a telephone number, and/or a physical postal address. PetPay may require information such as your social security number or tax ID, date of birth, bank account information, credit card information and/or other proof of identification in order to verify your identity and provide this service to you. Credit card information on an account may be stored and used for both billing and payment purposes. PetPay may contact members to confidentially request more information about themselves or their kennel or pets listed on the site, to ensure compliance with our rules.

Your birthdate, gender, ethnicity will not be publicly displayed in connection to your account and activity on the Site.

Your email address is publicly displayed and connected to your PetPay activity. Other people may see your date joined, feedback, ratings, profile information, pets listed for sale or for adoption, profile pages, sold listings, and personal reference comments.

PetPay automatically receives and records some information from your browser when you visit the site, such as your IP address, cookies and data about which pages you visit on the site through the use of log files provided by our third-party tracking-utility partners. This information helps us analyze and understand how the site works for members and visitors, and provide a more personalized experience for members and visitors.

Some members or visitors may connect to or register an PetPay account using an external third-party application, such as Facebook, Google, or Twitter. PetPay may receive some data from those connected third-party applications. Connecting your PetPay account to third-party applications or services is optional, and when you connect your account to an external app, you will be given the opportunity to grant permission.

PetPay may receive or collect information (for example: email address) about a person who is not yet a registered PetPay member (a “non-member”) in connection with certain PetPay features, including but not limited to: a non-member subscribing to an PetPay newsletter, a member inviting a non-member to visit PetPay.com, or a non-member engaging in a transaction. Non-member information is used only for the purpose it was originally submitted to PetPay. A non-member can contact PetPay Support if they do not want PetPay to retain their information.

PetPay uses the information described in this policy to provide and improve our services and products, for billing and payments, for identification and authentication purposes, to contact members or interested parties, and for general research and aggregate reporting.

PetPay’s Terms of Use require all account owners to be at least 18 years of age (or have the permission and supervision of a responsible parent or legal guardian), therefore, this policy does not discuss use of our site or services by minors.

Choice & Control

We know members of our community value having control over their own information, and therefore PetPay gives you the choice of providing, editing or removing certain information.

You may change or correct your PetPay account information. Sellers may remove certain optional information you no longer wish to be publicly visible, such as your full name by replacing it with your Kennel Name.

For various reasons, PetPay may contact you about our services or your activity. Some of these messages are required, service-related messages for members. Other messages are not required, and you can control which optional messages you choose to receive by changing your settings in your account.

If you have optionally connected your account to an external, third-party application, such as Facebook, Google, or Twitter, you can remove permission for the app by changing your account settings within the third-party application.

If you no longer wish to use PetPay’s services or receive service-related messages, then you may close your account. You may send an email to support@petpay.com to request account closure or the deletion of your information or any data of any kind pertaining to you.

Messages from PetPay

On occasion, PetPay will contact you. Primarily, messages are delivered by email, and every account is required to keep a valid email address on file to receive messages. In some situations, PetPay may contact you by telephone, SMS message or physical mail in order to provide you with information about products and features you my find of interest or to provide you with customer support.

Some messages from PetPay are service-related and required for members. Examples of service-related messages include, but are not limited to: a welcome/confirmation email when you register your account, notification of a transaction, or correspondence with PetPay’s support team. These messages are not promotional in nature. You may not opt-out of receiving service-related messages from PetPay, unless you close your account.

As a member, PetPay may also send you messages related to certain features on the site or your activity. PetPay may also send you news or updates about changes to our site or services. By default, members will receive these messages via email.

PetPay offers optional email newsletters. When you register for an account, or choose to subscribe, you will receive newsletters from us. Newsletters are available to both members and non-members. You may unsubscribe from newsletters by following the instructions contained in the newsletter emails.

A contact-importer feature via Facebook is available to help you request references from your friends. If someone in your contact list is not already a member, you may invite them to join PetPay. Recipients of invitations may opt out of receiving future invitations by following instructions in the messages.

Community

PetPay is both a marketplace and a community. We offer several features that allow members to connect. Please use common sense and good judgement when posting in these community spaces or sharing your personal information with others on PetPay. Be aware that any personal information you submit there can be read, collected, or used by others, or could be used to send you unsolicited messages. PetPay generally does not remove content from community spaces, and your posts may remain public after your account is closed. You are responsible for the personal information you choose to post on PetPay.

Another PetPay member may follow your public activity on PetPay to receive updates, for example: when you list a new puppy for sale or for adoption. You may choose to make certain activities private in your account settings. After a member has begun following your activity, you have the option to block that member if you do not wish to share your updates with that specific person.

Information Sharing & Disclosure

We want to respect your privacy. PetPay will not sell or disclose personally identifiable information to third parties without your explicit consent, except as specified in this policy.

As part of the buying and selling process, PetPay will facilitate the sharing of information between the two members involved in the transaction. As part of the buying or selling process, you may obtain another PetPay member's email address, physical address, payment information, and/or other information. As described in PetPay's Terms of Use, you have a limited license to use this information only for PetPay-related communications or for PetPay-facilitated transactions. PetPay has not granted you a license to use the information for unsolicited commercial messages. Without express consent from that person, you must not add any PetPay member to your email or physical mailing list.

From time to time, PetPay may make various aspects of our database of Your Information available to other parties for promotions of and solicitations for their goods or services that may be of interest to PetPay members. However, we will not distribute personal information about any individual -- in other words, while we might let our advertisers know that we have 1000 people in your zip code, we won't let third-party advertisers know that YOU live in your zip code. However, by accepting this Agreement, you expressly consent to such use and disclosure of non-personally identifiable information. Please note that PetPay maintains the right to send you periodic updates as PetPay deems necessary.

PetPay may release your personal information to a third-party in order comply with a subpoena or other legal requirement, or when we believe in good faith that such disclosure is necessary to comply with the law; prevent imminent physical harm or financial loss; or investigate or take action regarding illegal activities, suspected fraud, or violations of PetPay's Terms of Use. We may disclose personally identifiable information to parties in compliance with our Copyright and Intellectual Property Policy, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, PetPay may disclose name, address, country, phone number, email address and company name.

PetPay is affiliated with a variety of businesses and works closely with them. These businesses may offer promotions or sell items or services to you through PetPay’s services. PetPay may also provide services or sell products jointly with affiliated businesses. Due to the nature of our business model, when an affiliated business is associated with your transaction, we may share information that is related to such transaction with that affiliated business. PetPay may share aggregated demographic information with business partners.

In some cases, PetPay may choose to buy or sell assets. In these types of transactions, member information is typically one of the business assets that is transferred. PetPay will transfer information about you if PetPay is acquired by or merged with another company. In this event, PetPay will notify you by email or by putting a prominent notice on the site before information about you is transferred and becomes subject to a different privacy policy.

When you a load a page on PetPay that has a social plug-in from a third-party site or service, such as a Like or Send button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site.

We can only speak for ourselves; this policy does not apply to the practices of third parties that PetPay does not own or control, or individuals that PetPay does not employ or manage. If you provide your information to others on PetPay or throughout the Internet, different rules may apply to the use or disclosure of the information you provide to them. PetPay does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. PetPay is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the PetPay site. We encourage you to ask questions before you disclose your personal information to others.

We reserve the right to transfer information (including your personal data) to a third party in the event of a sale, merger, liquidation, receivership or transfer of all or substantially all of the assets of our company provided that the third party agrees to adhere to the terms of our Privacy Policy and provided that the third party only uses your personal data for the purposes that you provided it to us. You will be notified in the event of any such transfer and you will be afforded an opportunity to opt-out.

Cookies & Tracking Technologies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. If a user rejects the cookie, they may still use our site. The only drawback to this is that the user will be limited in some areas of our site. Cookies are also used to track promotional discounts on our Site. Next Day Pets, L.L.C. may set and access Next Day Pets, L.L.C. cookies on your computer. Next Day Pets, L.L.C. lets other companies that show advertisements on some of our pages to set and access their cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies do not have access to Next Day Pets, L.L.C. cookies.

PetPay may partner with third-party services who may use various tracking technologies, such as browser cookies or Flash cookies, to provide certain services or features. These technologies allow a partner to recognize your computer each time you visit PetPay, but do not allow access to personally identifiable information from PetPay. PetPay does not have access or control over these third-party technologies, and they are not covered by our privacy statement.

Security

The security of your personal information is important to us. Your PetPay account information is protected by a password. It is important that you protect against unauthorized access of your account and information by choosing your password carefully, and keeping your password and computer secure by signing out after using our services. PetPay will track the computers, smartphones, and/or any other internet device that is used to access your account including your internet provider and IP Address. If we detect an attempt to sign into your account from a device or internet provider not previously associated with your account then you will be required to input a verification code that will be sent to the email address on file. The code will also be sent as a text message to your mobile phone on file whereas standard message and data rates may apply.

PetPay encrypts sensitive information (such as credit card number) using secure socket layer technology (SSL). PetPay follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once PetPay receives it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Data Retention

PetPay will retain your information only for as long as is necessary or your account is active or as needed to provide you services. If you no longer want PetPay to use your information to provide you services, you may close your account. PetPay will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. You may inform us of any changes or requests in regards to your personal data, and in accordance with our obligations under local data protection law, we may update or delete your personal data accordingly.

Privacy Policy Changes

PetPay reserves the right to modify this privacy statement at any time, so please review it periodically. We’ll communicate changes by posting a notice on the site. If we make material changes to this policy you will be notified here, by email, or other places PetPay deems appropriate.
